ATTENTION: CONSUMERS WHO BOUGHT CERTAIN GENERIC PRESCRIPTION DRUGS IN THE UNITED STATES BETWEEN MAY 1, 2009, AND DECEMBER 31, 2019
HARTFORD, Conn., Oct. 19, 2026 /PRNewswire/ — Multiple settlements have been reached with some generic prescription drug manufacturers in three lawsuits brought by states’ attorneys general (“States”) alleging that purchasers, including consumers, paid artificially inflated prices for generic prescription drugs (“States’ Actions”). The States have proposed an Allocation and Distribution Plan to distribute Consumer Restitution Funds from the settlements to eligible consumers who submit timely claim forms. The Allocation and Distribution Plan covers purchases in the United States of certain generic drugs (“Drugs at Issue”) made between May 1, 2009, and December 31, 2019 (“Time Period”).
Who Is Eligible
You may be eligible if you are an individual who bought one or more Drugs at Issue in the United States between May 1, 2009, and December 31, 2019; did not buy them for resale or directly from any Defendant; are not an officer, director, management, or employee of any Defendant; and currently reside in a state, commonwealth, or territory that is a party to one or more settlements, or you currently reside in Alabama, Arkansas, Hawaii, or Texas (for Apotex-only eligibility). Eligibility is based on your current state of residence at the time you file your claim, not where you made your purchases.
What Benefits Are Available and How Amounts Are Determined
Most eligible consumers will choose between: Option 1 (an equal share per applicable settlement) or Option 2 (a share based on your estimated total out of pocket spend on Drugs at Issue during the Time Period) for each settlement where you are eligible. Consumers currently residing in Alabama, Arkansas, Hawaii, or Texas are eligible only for a fixed payment from Apotex settlement funds, with the amount to be determined, and do not choose Options 1 or 2. Final amounts will be calculated after claims are reviewed, based on the number of qualifying claimants, estimated qualifying purchases for Option 2, and applicable settlements for your state of residence.
Claim Form Required – How and When To Submit a Claim
The deadline for submitting a claim is March 8, 2027. To receive payment, you must submit a Claim Form certifying eligibility and purchases during the Time Period. You may submit online at www.AGGenericdrugs.com or download a form at www.AGGenericDrugs.com and mail it to the address on the form. Only signed, valid claims submitted by the Claims Deadline will be included in the Initial Distribution, though late claims may be considered for future distributions.
Right to Object or Opt Out of the Allocation and Distribution Plan and Litigation
If you want to comment on or object to the Allocation and Distribution Plan, then you must file a written objection on or before August 14, 2027. If you want to opt out of the Allocation and Distribution Plan and be excluded from the States’ Actions or a particular settlement, then you must submit a request to opt-out on or before August 14, 2027. To learn more about submitting an objection or a request to opt-out, go to www.AGGenericDrugs.com.
Documentation Not Required to Submit a Claim Form
No receipts are necessary for submitting a Claim Form. Option 2 requires you to estimate your total out of pocket spend. If you choose Option 2, the Claims Administrator may later request documentation to corroborate your estimated spend (and if so, a lack of documentation could affect an Eligible Consumer’s payment). Consumers who choose Option 1 and consumers residing in Alabama, Arkansas, Hawaii, or Texas need only certify qualifying purchases within the period.
How Distributions Will Be Made and When
Payments will be made after the Claim Deadline passes, claims are reviewed, disputes are resolved, and the Court grants final approval of the plan. You must choose between electronic payment via PayPal, Venmo, Zelle, or a mailed check. Electronic payment is encouraged, and checks may be delayed to reduce costs.
